Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Kinsman & Co Insights Dashboard (“Service”) operated by Kinsman & Co (“we”, “our”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding agreement to use the Service. If you are using the Service on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately at info@kinsmanco.com if you suspect unauthorised access to your account.

3. Service Description

The Kinsman & Co Insights Dashboard provides:

• Unified marketing analytics across Google Ads, Meta Ads, LinkedIn Ads, GA4, Google Search Console, and Shopify
• AI-powered performance insights and recommendations
• Creative content generation (copy, images, video) aligned to your brand guidelines
• Anomaly detection, alerting, and scheduled reporting
• Goal tracking and competitive benchmarking (plan-dependent)

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse-engineer, decompile, or disassemble any aspect of the Service
• Use automated scripts, bots, or scrapers to access the Service beyond what is provided through our Public API
• Share your account credentials with third parties or allow multiple individuals to use a single-user account
• Upload content that is unlawful, harmful, defamatory, or infringes upon intellectual property rights

5. Intellectual Property

Our IP: The Service, including its design, code, algorithms, documentation, and branding, is owned by Kinsman & Co and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for the duration of your subscription.

Your content: You retain ownership of all data, assets, and brand materials you upload to the Service. By uploading content, you grant us a limited licence to process, store, and display it as necessary to provide the Service.

Generated content: Creative assets (copy, images, video) generated by the Service using AI are provided for your commercial use. You are responsible for ensuring generated content complies with applicable advertising standards and platform policies.

6. Platform Connections

When you connect third-party advertising and analytics accounts via OAuth:

• You authorise us to access and retrieve performance data from those platforms on your behalf
• You are responsible for ensuring you have the necessary permissions to grant us access to those accounts
• We access data in read-only mode and do not modify your campaigns or account settings
• You may disconnect platforms at any time through the Settings page

7. Availability and Support

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. Unplanned downtime may occur due to circumstances beyond our control.

Support is available via email at info@kinsmanco.com. Response times depend on the severity of the issue and your subscription plan.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided “as is” without warranties of any kind, whether express or implied
• We do not guarantee the accuracy of AI-generated insights or recommendations. You should verify all insights before making business decisions
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
• Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

9. Indemnification

You agree to indemnify and hold harmless Kinsman & Co from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service if:

• You breach these Terms or our Acceptable Use policy
• Your subscription payment fails and is not resolved within the grace period
• We are required to do so by law

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through a notice on the dashboard at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
